Version 2026-09. These terms apply to anyone who creates an account or uses the Broderly service ("the Service"), published by the person or company identified in the legal notice ("the Publisher"). Using the Service constitutes acceptance of these terms.
1. Purpose of the Service
Broderly is browser-based software for drawing embroidery designs, importing images or existing embroidery files, reworking them, checking their quality and producing machine-embroidery files (in particular the DST, PES, EXP, JEF, VP3 and HUS formats). The Service is a preparation tool: it does not embroider, does not sell thread or fabric, and does not replace the operator's checks on the machine.
2. Account
- The account is personal. The user chooses a sign-in method offered by our authentication provider (email address, or a Google or Apple account) and remains responsible for access to their account.
- The Service is reserved for adults, or for minors with the consent of a legal guardian; it is intended for professionals (workshops, textile branding) as well as for private individuals.
- The Publisher may suspend an account in the event of fraud, obvious abuse (for example mass automation of exports, or sharing a paid account between several workshops) or non-payment, after informing the user except in an emergency.
3. Plans and beta
During the free beta period, every account has the Atelier+ level, with a reduced number of assistant assists. At the end of the beta, announced in the application at least 30 days in advance, a limited free plan and paid subscriptions apply under the terms of sale. Drawing, opening every format, converting, previewing, checking quality and printing the run sheet remain free. Subject to the plan are: the number of machine files per month and their size, expert mode, the automatic patch, personalised series, batch export, the garment workspace, the assistant, the quote on the printable sheet and the number of projects stored online.
Assistant (Atelier+ plan)
The Atelier+ plan gives access to an assistant based on an artificial-intelligence model: preparing an image, reviewing the design, suggesting settings and creating a design from a description. It is capped at a number of assists per month, shown in "My account" and subject to change in the future. The assistant suggests: nothing is applied to your design without your confirmation, and every action can be undone. Its answers may be inaccurate or unsuitable: they replace neither the quality check, nor the test on a scrap, nor your own judgement (see article 8). You remain responsible for the content you submit to the assistant, and in particular for holding the rights to the images you send. The data transmitted and the processors involved are described in the privacy policy. The assistant depends on third-party providers: its temporary unavailability does not entitle you to a refund of the current month.
3a. Referral programme
Broderly may, at its discretion, give certain users a referral link. When a person creates an account after following that link and then takes out a subscription, the referrer receives free days of Atelier+ access, according to the scale displayed in their account area (currently 15 days for an Atelier subscription, 30 days for an Atelier+ subscription). These days are added to their access, are neither transferable nor convertible into money, and give rise to no refund. An account can be referred only once, cannot refer itself, and only accounts created within 30 days of using the link are taken into account. Broderly may suspend the programme or withdraw referrer status in the event of abuse (fictitious accounts, subscriptions taken out and then cancelled solely to obtain the reward, misleading advertising), without affecting days already used.
4. Your designs and your content
- You remain the owner of your designs, images, texts and files. The Publisher claims no rights over them and does not use them for any purpose other than operating the Service.
- Designs are drawn and previewed in your browser. When a machine file is produced, the design is sent to the server, converted and returned; the server then keeps only metadata (format, stitch count, dimensions, design name) for billing, statistics and support purposes. The projects you save in "My work", however, are kept on your account until you delete them (30-day bin, then permanent erasure). See the privacy policy.
- You warrant that you hold the necessary rights to the images, logos, fonts and files you import (copyright, trademarks, font licences). You are solely responsible for the use made of the embroideries produced.
5. Intellectual property of the Service
The software, its stitch engine, its interfaces, its documentation, its brand and its logo belong to the Publisher. A subscription grants a personal, non-exclusive and non-transferable right to use the Service, without any right to copy it, to decompile it for commercial reuse, to extract its stitch-generation libraries or to circumvent the server's access controls. The code loaded by the browser is visible by nature; viewing it grants no licence.
6. Acceptable use
It is forbidden to use the Service to produce embroideries that infringe trademarks or protected works without authorisation, to attempt to access other users' accounts or the administration area, to deliberately overload the servers or to automate exports beyond normal workshop use. The Publisher may set technical limits (design size, number of requests) to protect the Service.
7. Availability and changes
The Service is provided "as is", with the aim of continuous availability but without any guarantee of permanent availability. Interruptions for maintenance may occur; when scheduled, they are announced in the application. The Publisher develops the Service (new features, formats, fixes) and may withdraw a feature while preserving, as far as possible, the compatibility of saved projects (.broderly.json files). You are advised to save your projects and machine files on your own computer.
8. Liability — important clause for embroidery
The Service prepares files for industrial or domestic machines. The operator remains solely responsible for starting the machine. Before every embroidery, it is up to the operator to check the hoop fitted and its usable area, the centring, the order of colours and needles, the programmed stops and the density in relation to the fabric and stabiliser, and to carry out a test on a scrap.
To the fullest extent permitted by law, the Publisher is not liable for broken needles, damage to the hoop, the machine, the fabric or the garment, or for loss of production, materials, orders or profit resulting from the use of a file produced with the Service, including in the event of a software error. The automatic checks (stitches outside the hoop, very short stitches, density, trims) and the suggestions of the Atelier+ assistant are aids and do not replace the operator's judgement.
The Publisher's liability, if engaged, is limited to the amount paid by the user for the last twelve months of subscription. This limitation does not apply to personal injury or where the law prohibits it; consumers retain their statutory guarantees.
9. Support
Support is provided by email at support@broderly.com and through the Help and FAQ page, in English and French, on business days. Indicative response times per plan are given on that page.
10. Termination
You may ask support to delete your account and your projects at any time (reply within one month); current subscriptions follow the rules of the terms of sale. The Publisher may terminate the account in the event of a serious breach of these terms after a formal notice that has remained without effect for 15 days, or immediately in the event of fraud.
11. Personal data
Data processing is described in the privacy policy, which forms part of these terms.
12. Changes to the terms
The Publisher may amend these terms. Significant changes are announced in the application and require renewed acceptance at the next sign-in. The version in force is dated at the top of the document.
13. Governing law and disputes
These terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution; consumers may make free use of the consumer mediator designated in the legal notice or of the European online dispute resolution platform. Failing that, the competent courts are those of the Publisher's registered office, subject to the protective rules applicable to consumers.
